Petitioner is the fourth accused in Crime No. 588 of

2010 of Paripally Police Station. Offences alleged agaisnt him are under sections 465, 468 and 471 and 120B IPC. Apprehending arrest, this petition is filed for anticipatory bail.

It is alleged that this petitioner created false S.S.L.C., driving licence and election identity card for the purpose of enabling the first accused to obtain passport. Learned counsel for the petitioner submits that the alleged incident is of the year 2010. The petitioner sutained head injury in an accident that took place in 2011 and thereafter he is seen disoriented, the learned counsel submits.

Learned Public Prosecutor, after getting instruction from the police, submits that the petitioner had sustained injuries in an accident but, however, he has to be interrogated to get certain details with regrd to the incident

involved in the case and also regarding the nine other crimes.

In these circumstances, I am not inclined to

grant anticipatory bail to the petitoiner. Hence, this petition is dismissed.

If the petitioner surrenders before the Police/Investigating Officer, after interrogation the petitioner shall be produced before the Magistrate and if the petitioner applies for bail the learned Magistrate will dispose of the same in accordance with law, but after hearing the learned Assistant Public Prosecutor as well and also after perusal of the case diary, if so required and also after considering the facts and circumstances of the case. If the Investigating Officer files application for police custody for further interrogation that shall also be considered by the learned Magistrate in accordance with law. The mental condition of the petitioner has also to be considered by the learned Magistrate.
