The petitioner has approached this Court seeking for a direction to include him in Ext. P3 Rank List, simultaneously praying to set aside the said List to the extent he has not been included therein.

that the petitioner has approached this Court after a deep slumber of more than three years, seeking to be included in Ext.P3 List dat ed 18.09.2008. Obviously, the petitioner was sleeping over his rights, if any, and no material is produced before this Court to draw an inference that he had approached the concerned respondent in time. The petitioner is not entitled to get any relief invoking the discretionary jurisdiction vested in this Court, as made clear by the Apex Court in AIR 1970 SC
470 ( Ravindranath Bose vs. Union of India).
In the above circumstance, interference is declined and the writ petition is dismissed.
