The petitioner has limited grievance against the C.A.T. order which says that the petitioner can register his name with the Live Register for discharged employees maintained by the respondent only after getting discharge from service.

We have heard the learned counsel for the petitioner and Assistant Solicitor General, Sri.P.Parameswaran Nair, for respondents.

As of now, the petitioner is serving the post office at Irinchayam as GDSMB-II. Petitioner's post is going to be filled up by a regular employee being recruited. Obviously, the petitioner can continue until the substitute comes. Petitioner's claim is that if he is simultaneously registered in the Live Register, he can be accommodated in the other post existing in the department. We do not think there can be any objection to it. We accordingly direct the respondents to register the name

of the petitioner in the Live Register simultaneously on his release on replacement by the selected employee and consider him for re-employment in posts available in the department in accordance with the norms. The petitioner will submit the application along with copy of the judgment for effecting registration simultaneously with his release, so that, on the date of release itself his name will appear in the Live Register for being considered for employment.
