This O.P. (CAT) is filed challenging the interim orders issued by the Tribunal declining the direction sought ie. to permit the petitioners to undergo training for appointment as Assistant Sub Inspector of Police (Wireless Operator & Radio Technician). Petitioners' case is that even though they have opted to participate the test conducted for selection, they were not called for the test and opportunity was denied to them. We do not want to decide the case on merits because the O.A. is pending before the CAT. The only question we have to consider is the prayer of the petitioners to permit them to undergo training. Standing counsel for Lakshadweep Administration submitted that out of the 80 passed in the test, 16 in the top ie. seniors are sent for training – 12 at Bangalore and 4 at Delhi. Petitioners' prayer, in our view, cannot be granted because they have neither participated in the test nor qualified for training. However, since they are

seniors to others who are now selected and sent for training, it is for the petitioners to argue the case on merits before the Tribunal and it is for the Tribunal to mould the relief.

The O.P. (CAT) is disposed of directing the Tribunal to dispose of the O.A. and connected cases at the earliest and in any case, within a period of three weeks from the date of receipt of a copy of this judgment. We direct the parties to file documents/counter and to appear in the case on the first date of posting granted by the Tribunal.
