JUDGMENT

The petitioner is an advocate practicing at Chegannur. He is a member of the Bar Association, Chengannur. It is stated that he is having a standing of 43 years at the Bar. The Bar Association suspended the petitioner from the Association. That was challenged by him in O.S.No.177 of 2010 before the Munsiff's Court, Mavelikkara. It is stated that no interim order was granted by the trial court. Because of the order of suspension, the petitioner is put to great hardship, submits the counsel. The petitioner moved for posting the suit in the special list for trial. The court below included the suit in the special list for May, 2011. The prayer in the Original Petition is to issue a direction to the Munsiff's Court, Mavelikkara to dispose of the suit expeditiously by posting the suit in the special list for February, 2011.

Notice was served on the fourth respondent. It is stated

that respondents 1 to 3 are exparte. The suit was transferred from

Munsiff's Court, Chengannur to the Munsiff's Court, Mavelikkara. Notice was served on the counsel appearing for defendants 1 and 2 before the Munsiff's Court, Chengannur. However, the counsel for the third defendant, who was appearing in the Munsiff's Court, Chengannur, did not accept the notice. It is stated that on 22.1.2011, defendants 1 to 3 were set exparte.

In the facts and circumstances of the case, the Original Petition is disposed of as follows:

a) The learned Munsiff shall dispose of O.S.No.177 of 2010 as expeditiously as possible.

b) If possible, the learned Munsiff shall include the suit in the special list for March, 2011, by posting the case in the third week of March, 2011, unless it is otherwise impossible. Issue certified copy of the judgment today itself.
