The appellants are the claimants before the Reference
Court. They are the legal heirs of the original vendee under Ext.A1. For the land acquired from their possession, a total amount of Rs.12,14,573/- was fixed as compensation. Though in Ext.A1 it was stated that the jenm right was assigned to the vendee, in fact, the vendee had obtained only “kuzhikkanam” right. Finding that there is no document to show that the vendee has purchased jenm right from the Land Tribunal, the learned Subordinate Judge directed 1/4th of the amount to be paid to the Government and the remainder Rs.9,51,964/-, payable to the claimants. That
amount was already released in favour of the claimants.

Now the claim is in respect of the amount in deposit, Rs.2,62,609/-. Admittedly, the claimants are having title over the property except the fact that the alleged jenm right was not purchased through the Land Tribunal. Even if any amount was payable towards purchase price, that may be only about Rs.100/-. We do not find any reason to retain the amount of Rs.2,62,609/- in court deposit. It is submitted by the learned counsel for the appellants that the Government has exempted the cultivating tenants from paying the purchase price. Hence, this appeal is allowed. The claimants are entitled to withdraw the amount of Rs.2,62,609/- lying in deposit before the Sub Court, Thalassery.
