JUDGMENT

The petitioner is a member of the Board of Directors of the second respondent Bank. The Bank notified appointments to the posts of Gold Appraisers and Peons on 21.10.2009. The third respondent, who is another member of the Board challenged the action of the Bank and sought invocation of the power under Rule 176 of Kerala Cooperative Societies Rules. He had also filed WP(C) 1042 of 2010 seeking a direction from this court to dispose of his writ petition. The said writ petition was disposed of directing the first respondent to take a decision within two months from the date of receipt of a copy of the judgment. The petitioner has filed a representation before the first respondent seeking an early disposal of the petition filed by the third respondent since the selection was held up. He has also prayed for an opportunity of being heard. The petitioner complains that his representation has not been considered so far.

submits that the matter has been posted for hearing on 24.3.2010. He has no objection in petitioner also being directed to be heard before a

final decision is taken in the matter.

In the above circumstances, this writ petition is disposed of directing the first respondent to afford an opportunity of being heard to the petitioner also while passing final orders on the petition submitted by the third respondent that has been directed to be disposed of by this court as per the judgment in WP(C) 1042 of 2010.
