JUDGMENT

The petitioner is the owner of a parcel of land situate within

the local limits of Chapparappadavu Grama Panchayat. With a view to put up a commercial building in that parcel of land he applied to the first respondent for a building permit. Ext.P4 building permit was thereupon issued on 6.3.2009. It is stated that on the strength of Ext.P4 building permit, the construction of a part of the building, which is a row of shop rooms, was completed and thereupon the petitioner submitted the original of Ext.P1 application to number the building and to issue an occupancy certificate with a view to enable the petitioner to let out the said rooms and to earn income. The grievance voiced by the petitioner is that though nearly one year has passed after Ext.P1 application was filed, till date no action has been taken thereon by the first respondent. In this writ petition, the petitioner seeks a direction to the first respondent to consider Ext.P1 and pass appropriate orders thereon expeditiously.

When the writ petition came up for hearing today Sri.Sunil Nair Palakkat, learned standing counsel appearing for the first respondent, submitted that the Secretary will enquire into Ext.P1 application and take an appropriate decision thereon in accordance with law expeditiously and in any event within two weeks from today. In the light of the said submission I dispose of the writ petition with a direction to the first respondent to enquire into Ext.P1 application and take an appropriate decision thereon expeditiously and in any event within two weeks from today.
