This is an application for anticipatory bail under Section 438 of the Code of Criminal Procedure. The petitioner is accused No.2 in Crime No.131 of 2010 of Ezhukone Police Station, Kollam District.

The offences alleged against the petitioner are under Sections 498A and 306 of the Indian Penal Code.

The first accused is the husband of the victim who committed suicide on 6.2.2010 at 8.20 A.M. The marriage between the first accused and the victim took place on 2.8.2009. The first accused and the deceased were in love with each other. They had eloped. Subsequently, their marriage was solemnised by the parents of both parties. The deceased was staying in the house of the first accused, where, apart from them, the petitioner, the mother of the first accused, was also there. At the time when the deceased committed suicide, the petitioner was not available in the house. The first accused was arrested on 8.2.2010.

Heard the learned counsel for the petitioner and the learned Public Prosecutor. I have also gone through the case diary.

Taking into account the facts and circumstances of the case, the nature of the offence and other circumstances, I am of the view that anticipatory bail can be granted to the petitioner.

There will be a direction that in the event of the arrest of

the petitioner, the officer in charge of the police station shall release her on bail on her executing bond for Rs.15,000/- with two solvent sureties for the like amount to the satisfaction of the officer concerned, subject to the following conditions:

a) The petitioner shall not try to influence the prosecution witnesses or tamper with the evidence;

¶20

b) The petitioner shall not commit any offence or indulge in any prejudicial activity while on bail;

¶21

c) In case of breach of any of the conditions mentioned above, the bail shall be liable to be cancelled.

¶22

The Bail Application is allowed to the extent indicated above.
