This petition is for anticipatory bail.

¶20

The alleged offences are under Sections 143, 147, 148, 353, 332, 333 r/w Section 149 IPC. According to prosecution, petitioner along with other accused formed themselves into an unlawful assembly and armed with deadly weapons, attacked police officials who were on duty and the Circle Inspector was seriously injured. They also committed various other offences.

Learned counsel for petitioner submitted that petitioner was implicated due to a misunderstanding. He is not involved in the offence. He is totally innocent of the allegations made. There is some mistake in the identity. On these submissions, petitioner was directed to appear before the Investigating Officer and accordingly he surrendered before him. He was also questioned by police. Petitioner has explained his innocence to the Investigating Officer, it is submitted.

This petition is not opposed. On hearing both sides, I am satisfied that anticipatory bail can be granted on conditions. Hence, the following order is passed.

(1) Petitioner shall surrender before the Magistrate Court concerned within seven days from today.

¶26

(2) On such surrender, petitioner shall be released on bail on his executing a bond for Rs.10,000/- (Rupees ten thousand only) each with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate on condition that he shall report before the Investigating Officer as and when directed and co-operate with investigation.

Petition is allowed.
