All these Writ Petitions arise out of E.P.21/05 in O.S.33/98 on the file of the Sub Court, Nedumangad. The petitioners herein filed claim petitions while execution of the decree in O.S.33/98 was in progress and those claim petitions viz. E.A. Nos.134, 135, 137 and 139 of 2005 in E.P.21/05 were all dismissed by the court below for default. The petitioners filed applications for restoration of the claim petitions. The court below dismissed the restoration petitions vide separate orders dt.18/12/08 which are produced as Ext.P6 in W.P.C. Nos.813/09 and 779/09 and as Ext.P7 in W.P.C Nos.816/09 and 814 of 2009. Respondents have entered appearance in all these Writ Petitions and counsel on both sides submit that these Writ Petitions be disposed

of setting aside the orders assailed and directing the court below to afford opportunity to the claim petitioners to adduce evidence on the claim petitions filed by them setting aside the order of dismissal for default passed on those petitions.

In the result, allowing these writ

petitions, I set aside the impugned orders in these Writ Petitions namely Ext.P6 order in Writ Petition Nos.813 and 779 of 2009 and

Ext.P7 order produced in Writ Petition Nos.816 and 814 of 2009 as also the order dismissing E.A. Nos.134, 135, 137 and 139 of 2005 for default and direct the Sub Judge, Nedumangad to dispose of those claim petitions afresh on merits affording opportunity to the petitioners and the decree holder/respondent to adduce evidence in the matter both oral and documentary as the parties desire to adduce. The court below shall expedite the enquiry in

the claim petitions and shall dispose of all the four claim petitions positively within one
