JUDGMENT

The petitioner is presently working as High School Assistant (English) in Idukki District. She applied for inter district transfer to Ernakulam District by submitting Ext.P2 application before the Principal of the School. When the Principal did not forward the application to the Deputy Director of Education, Idukki, she filed W.P.(C)No.31512 of 2008 in this Court. By Ext.P5 judgment delivered on 12.11.2008, this Court disposed of the said Writ Petition with a direction to the Principal to forward the application to the Deputy Director of Education, Idukki who in turn was directed to assess the eligibility of the petitioner and if found eligible, forward the application for inter district transfer to Deputy Director of Education, Ernakulam. The petitioner submits that though the Deputy Director of Education, Idukki has forwarded the application together with his remarks to the Deputy Director of Education, Ernakulam, the said authority has not yet taken a decision in the matter. The petitioner inter alia prays for a direction to the respondent to consider and pass orders on Ext.P2 application.

This Court had by Ext.P5 judgment directed the Principal of the School to forward the application to the Deputy Director of Education, Idukki District who in turn was directed to forward it to

the Deputy Director of Education, Ernakulam, if the petitioner is found eligible for inter district transfer. Since the Deputy Director of Education, Idukki has forwarded the application for inter district transfer to the respondent in this Writ Petition, viz. the Deputy Director of Education, Ernakulam, though this Court had not in Ext.P5 judgment directed him to dispose of the application for inter district transfer, the respondent ought to have in my opinion, passed orders on the same without awaiting for a further direction from this Court.

In these circumstances, I dispose of the Writ Petition with a direction to the Deputy Director of Education, Ernakulam to pass final orders on Ext.P2 application submitted by the petitioner, if it has been received by him from the Deputy Director of Education, Idukki. This shall be done within one month from the date on which the petitioner produces a certified copy of this judgment before the Deputy Director of Education, Ernakulam.
