J U D G M E N T

Petitioner is a candidate included in Ext.P1 ranked list published by the Public Service Commission for the post of Reporter Grade-II(Malayalam) under the first respondent. His grievance is that, though there exist 7 vacancies, those vacancies are not reported to the PSC to advise candidates from the list. It is also their case that, if promotions are effected from the post of Reporter Grade-II there would arise more vacancies to advise candidates.

Learned Government Pleader on instructions submits that

out of 12 vacancies, available 7 vacancies have already been filled up from Ext.P1 list and that remaining 5 vacancies have already been reported to the PSC for advising candidates. Therefore, as at present the available vacancies have been reported and it is for the 2^nd respondent to advise candidates from the ranked list.

Petitioner may produce a coy of the judgment before the 2^nd respondent, who shall take steps for advising candidates from Ext.P1 ranked list, if not already advised.

In so far as the contention of the petitioner that if promotions are effected further vacancies will arise, now that contingency does not exist, as admittedly promotions have not been effected. Therefore, it will be open to the petitioner to approach the appropriate authorities as and when vacancy arises.
