JUDGMENT

The petitioner was appointed as L.P.S.A. in A.D.V.U.P. School, Peringandoor in a leave vacancy, as per Ext.P1. The approval of appointment was declined as per Ext.P2, initially by the District Educational Officer. It was modified pursuant to the order passed in appeal by the Director of Public Instruction, to be limited upto 31.3.2005 on daily wage basis. Subsequently, a regular vacancy arose on 1.6.2005 and by Ext.P4, the shifting of appointment has been approved also.

The petitioner is seeking the benefit of the judgment of this court in Unni Narayanan v. State of Kerala (2009 (2) KLT 604) and claiming the same, she has filed Ext.P5 revision petition before the Government.

There will be a direction to the first respondent to take a decision on Ext.P5 after hearing the petitioner and the Manager, within a period of four months from the date of receipt of a copy of this judgment.

The writ petition is disposed of as above. No costs.
