Appellant/Petitioner approached this court for quashing Ext.P9 order. Counsel for the respondent submitted that Ext.P9 order was passed after giving many opportunities to the appellant, but, appellant refused to avail those opportunities. Anyway, considering the contentions on merit, this court ordered that if Rs.50,000/- is paid, petitioner should be given an opportunity to be heard. After payment of Rs.50,000/-, another Rs.25,000/- was also paid. Therefore, fresh order was passed by the respondent after hearing the petitioner wherein amounts were substantially reduced. Balance amount to be paid is only Rs.38,784/-. If balance amount as per the fresh order is not paid so far, it should be paid within three months from the date of receipt of a copy of this judgment in full settlement.
The appeal is disposed of accordingly.
