JUDGMENT

This petition is filed with a prayer to set aside Annexure B order passed by the Judicial First Class Magistrate, Tirur in C.M.P.No.7807 of 2008. By the said order the learned Magistrate had not invoked his power under Section 457 of the Code of Criminal Procedure. I am not going into the merits of the case for the reason that there is already a proceeding pending before the District Collector and provisions of the Kerala Anti Social Activities (Prevention) Act, 2007, i.e. Section 17(1) to (3), deals with the situation. Therefore, it is sufficient if a direction is given to the second respondent to pass appropriate orders after hearing all concerned within a time limit of one month from today.
