JUDGMENT

The complaint in this Contempt Petition is regarding the alleged non-compliance of Annexure A2 judgment in WPC No.21702/08. By this judgment it was ordered that, the 2^nd respondent shall enquire into Ext.P1, where the petitioner complains about the construction of a multi-storied flat by the 5^th respondent.

On instructions the counsel for the respondent submits that, in pursuance to the judgment, the petitioner was heard on 03.10.08 and the site in question was inspected on 11.11.08. It is stated that on that occasion the petitioner was absent and for that reason it has been decided to conduct a fresh inspection with notice to the petitioner. It is stated that once the fresh inspection is conducted, final orders will be passed as directed.

Considering the submissions now made before me, I am not inclined to think that a case has been made out against the respondent to proceed with this petition. It is ordered that, the second inspection will be conducted within two weeks and the same
