This is an application for anticipatory bail under Section 438 of the Code of Criminal Procedure. The petitioners are accused Nos.1 to 6 in Crime No.169 of 2009 of Payyannoor Police Station.

The offences alleged against the petitioners are under Sections 143, 147, 148, 448 and 427 read with Section 149 of the Indian Penal Code and Sections 3 and 5 of the Explosive Substance Act.

The prosecution case is that the accused persons came to the residence of the de facto complainant after midnight on 11.4.2009 and hurled country bombs. On hearing the noise, the de facto complainant woke up and he saw the accused leaving the place on two motor bikes. They were armed with swords.

Taking into account the nature of the allegations made against the accused persons and also the facts and circumstances
