JUDGMENT

The petitioner claims to be the legal heir of late P.A. Mariyamma, who was granted a LPG distributorship at Kottayam Malabar by respondents 1 to 3 in the reserved category available to Freedom Fighters (Woman). On her death, on the strength of a will and codicil, one Smt. D. Saleenamma applied for reconstitution of the dealership in her name. By Ext.P3 judgment, I held that, that lady could not claim reconstitution of dealership in her name based on the will and codicil. Now the petitioner has come up with a claim that as a legal heir of late P.A. Mariyamma, he is entitled to get the dealership reconstituted in his name. He has filed Ext.P5 representation in this regard. He now confines his relief for a direction to the 1^st respondent to consider and pass orders on Ext.P5 expeditiously.

I have heard the learned standing counsel appearing for respondents 1 to 3 also. After having heard both sides, I direct the 1^st respondent to consider and pass orders on Ext.P5 as

expeditiously as possible, at any rate, within one month from the date of receipt of a copy of this judgment. However, I hasten to add that I have not considered the claim of the petitioner on merits and it would be entirely for the 1^st respondent to decide the validity of the petitioner's claim in accordance with the guidelines applicable. The petitioner shall forward a copy of this judgment along with a copy of the writ petition to the 1^st respondent for compliance.
