Writ petitioners are the review petitioners. The issue pertains to appointment to the last grade service. Petitioners claim the benefit of the judgment of this court in W.A.60/2000. It is seen that the said issue is not canvassed before this court and hence could not be considered while passing the judgment. Be that as it may, in view of the submission regarding the application of the bench decision, it is only appropriate that the writ petition is heard afresh on merits. Accordingly, the review petition is allowed and the judgment dated 28.7.2004 in W.P.(C) No.22308/04 is recalled. Post the writ petition for hearing. Needless to say, the interim order passed by this court in the writ petition will continue.
