ORDER
The petitioner who claims to be the registered owner of a Maruti Alto Car bearing Reregistration No.KL-8 AD 9129 seized by the Aluva police in connection with Crime No.785 of 2007 registered for offences punishable under Sections 55(a) and 55(i) of the Abkari Act, challenges the order dated 15-2-2008 passed by the Judicial First Class Magistrate-I, Aluva rejecting the petitioner's application for interim custody of the vehicle under Section 451 Cr.P.C. The car in question was parked near the premises from where 3905 litres of spirit were seized. The investigation is still in the preliminary stage and the police have not yet any information as to whether the car was used for carrying the contraband spirit or not. Hence, the request of the petitioner for interim custody of the vehicle was premature. I see no reason to interfere with the impugned order. This Crl.M.C.is dismissed without prejudice to the right of the petitioner to move again after the progress of the investigation.
