The learned Public Prosecutor, after taking instructions from all concerned submits that after the enquiry conducted, the Superintendent of Police is now satisfied that a further investigation deserves to be conducted. On 03/11/2008, an order has been passed by the Superintendent of Police directing conduct of further investigation under Section 173(8) Cr.P.C. Necessary steps are being taken to take the leave of the Magistrate concerned and to conduct the further investigation. It is assured that results of such further investigation can be expected within a period of one month.

I am, in these circumstances satisfied and the learned counsel for the petitioner accepts that no further direction need be issued in this Crl.M.C.

This Crl.M.C is accordingly dismissed. Needless to say, the petitioner's option to approach this court again later if a proper investigation is not conducted shall remain unfettered by the dismissal of this Crl.M.C.
