Petitioners who are husband and wife are the accused in C.C. 760 of 2005 on the file of the Judl. First Class Magistrate, Vaikom for offences punishable under Sections 461, 381 and 411 read with Sec. 34 I.P.C. Consequent on the non-appearance of the petitioners before the J.F.C.M., Vaikom on 21-08-2007, their bail bonds have been cancelled and non-bailable warrants of arrest have been issued. They seem to have valid explanation for their non-appearance before the court below on 21-8-2007.

In the facts and circumstances of the case, this Crl.M.C. is disposed of permitting the petitioners to surrender before the Magistrate and to file an application for regular bail within two weeks from today. In case the petitioners comply with the above condition, their bail application shall be considered and disposed of by the Magistrate, preferably, on the same date on which it is filed, after considering the explanation offered by them for their previous nonappearance.
