ORDER

Application for regular bail. Petitioner is the 1^st accused. Altogether there are 2 accused persons. The alleged incident took place on 28.11.07. The victim had suffered a stab injury with a knife. F.I.R was registered only on 01.12.07. The petitioner was arrested on 16.01.08. He continues in custody from that date.

The learned counsel for the petitioner prays that the petitioner, who has remained in custody from 16.01.08, may now be enlarged on bail subject to appropriate terms and conditions.

The learned Public Prosecutor, after taking instructions, submits that the victim, who had suffered serious injury-a stab, has now been discharged from the hospital. The State has no objection against grant of bail to the petitioner now subject of course to appropriate conditions which shall ensure the interests of a fair, efficient and expeditious investigation and shall safeguard the interests of law and order in the locality.

I am satisfied that the petitioner can now be enlarged on bail subject to appropriate terms and conditions.

In the result, this application is allowed. The petitioner shall be released on bail on the following terms and conditions.

i) The petitioner shall execute a bond for Rs.50,000/(Rupees Fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate;

ii) The petitioner shall make himself available for interrogation before the Investigating Officer between 10 a.m and 12 noon on all Mondays and Fridays for a period of two months and thereafter as and when directed by the Investigating Officer in writing to do so;

iii) Except for the purpose of complying with condition No. (ii) above, the petitioner shall not enter the limits of Vizhinjam Police Station during the said period of 2 months.
