The revision petitioner stands convicted for the offence under section 138 of the Negotiable Instruments Act and sentenced to undergo simple imprisonment for six months.

¶37

The revision petitioner has only sought for modification of sentence. It is submitted that the revision petitioner is undergoing imprisonment. In the circumstances, sentence is modified to the period of imprisonment already undergone and to pay a compensation of Rs. 68,900/- vide section 357(3) Cr.P.C and in default to undergo simple imprisonment for three months. The revision petitioner is ordered to be released on remitting the compensation amount before Judicial First Class Magistrate -I, Aluva.
