This application is for regular bail. The petitioner is the 6^th

¶16

accused. He faces allegations along with co-accused for offences punishable, inter alia, under Section 364 A I.P.C. I have adverted to facts in detail earlier while considering the application for regular bail of 4 of the co-accused in the order dated 5^th September, 2007 in B.A.No.5278 of 2007. The alleged incident took place on 4.8.07. The petitioner was arrested and his arrest was recorded in this crime on 23.08.07. He continues in custody from that date.

The learned counsel for the petitioner prays, the learned Public Prosecutor does not oppose the said prayer and I am satisfied that the petitioner can also be granted regular bail now. In the absence of opposition and in the light of the detailed advertence to facts in the said earlier application for bail, I am satisfied, that it is not necessary to advert to facts again in any further detail in this order.

In the result, this application is allowed. The petitioner shall be released on bail on the following terms and conditions.

i) The petitioner shall execute a bond for Rs.1,00,000/(Rupees One lakh only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate;

ii) The petitioner shall make himself available for interrogation before the Investigating Officer between 10 a.m and 12 noon on all Mondays and Fridays for a period of three months and thereafter as and when directed by the Investigating Officer in writing to do so;

iii) Except for the purpose of complying with condition No.(ii) above, the petitioner shall not enter the jurisdiction of Nallalam Police Station until further orders without the prior permission of the learned Magistrate.
