In view of the reasons put forward by the petitioner, is hereby granted time till 8-6-2007 to surrender before the Magistrate/Investigating Officer and seek regular bail. In case he does so within this extended time, he shall be deemed to have complied with the conditions in the order dated 8-5-2007 in B.A.No. 2509 of 2007 .

Petitioner who is the accused No. in Crime No.64 of 2007 of Kottarakkara Excise Range for an offence punishable under Section 55 (a) of the Abkari Act seeks anticipatory bail.

The learned Public Prosecutor opposed the application.

¶32

Anticipatory bail cannot be granted in a case of this nature. There is no reason why the petitioner should not surrender before the Magistrate having jurisdiction and seek regular bail. Accordingly, if the petitioner surrenders before the Magistrate concerned and file an application for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same date on which it is filed.
