Petitioner, who is the 10^th accused in Crime No.579 of 2006 of Kottiyam Police Station for offences punishable under Sections 143, 147,148, 450, 324, 326, 427,307, 347, 506(2), 120(B) I.P.C. read with Section 27 of Arms Act, seeks anticipatory bail.

The learned public Prosecutor opposed the application.

The occurrence took place on 7.9.2006 at about 8.45 p.m.

The armed assailants about 25 in number are alleged to have committed rioting and looting as a counter blast.

Having regard to the nature of injuries sustained by the injured, who are all innocent persons, I am not inclined to grant anticipatory bail to the petitioner. There is no reason why the petitioner should not surrender before the Investigating Officer for the further progress of the investigation. Accordingly, if the petitioner surrenders before the

Investigating Officer within one week from today, he shall be interrogated and produced before the Magistrate having jurisdiction, who shall consider the regular bail application of the petitioner preferably on the same day on which it is filed.
