This Writ Petition (Habeas Corpus) is filed seeking a

direction to respondent No.4 to produce the writ petitioner's minor child from the illegal/unlawful custody of respondent No.5 and to handover the custody of the minor child to the writ petitioner.

2. We have heard the learned counsel appearing for the writ petitioner, the learned High Court Government Pleader appearing for respondents No.1 to 4 and the learned counsel appearing for respondent No.5 as well as additionally impleaded respondent No.6, who is the father of the child.

3. The learned counsel appearing for the writ petitioner submits that the counselling was being conducted at the NIMHANS, Bengaluru and that the child has not been interacting with the writ petitioner at all.

4. The learned counsel appearing for the father of the child submits that G & WC case has been registered before the Family Court, Mangalore and that all the parties are residents of Mangalore.

5. In the above circumstances, we are of the view that the matter is required to be considered by the jurisdictional Family Court since the Family Court has already been approached by the father of the child. We leave all contentions open and close this Writ Petition (Habeas Corpus), reserving liberty to the parties to approach the Family Court for appropriate orders in the matter.

6. Accordingly, this Writ Petition (Habeas Corpus) stands disposed of.

We make it clear that the report of the counselling conducted at NIMHANS, Bengaluru, shall be forwarded to the Family Court, Mangalore, in a sealed cover. We hope that further counselling as found necessary shall be carried

out under the orders of the Family Court, Mangalore, at the convenience of the parties and the child in Mangalore.
