The petitioners have sought for a declaration that the notification bearing No.HSA(SR) 38/83-84 dated 12.03.1984 (published in the Karnataka Gazette on 10.05.1984) and the notification bearing No.LAQ.HSA.6/86-87 dated 28.07.1986 (published in the Karnataka Gazette on 14.08.1986), both issued by the respondent No.2 have lapsed as no award was passed within two years from the date of the final notification as per Section 11A of the Land Acquisition Act, 1894. They have also sought to quash the letter/Reminder-3 bearing No. �ೆ�.ಎ�.ಎ.ಎ�.ಆ�.(�) 4/83-84 dated 03.07.2012 issued by the

respondent No.2 to the Executive Officer, Taluk Panchayat, Gubbi.

When this petition is listed for preliminary hearing in 'B' group today, the learned Additional Government Advocate has filed a memo stating that a preliminary notification dated 12.03.1984 was issued by the respondent No.2 under Section 3(1) of the Karnataka Acquisition of Lands for Grant of House Sites Act, 1972 (for short, 'Act, 1972') but no final notification

was issued in so far as it relates to the lands, which are the subject matter of this writ petition and that physical possession of the land continues with the petitioners and that the State has not taken over possession of the same. Therefore, steps would be taken to withdraw the notification issued under Section 3(1) of the Act, 1972, within reasonable time to be stipulated by this Court and that necessary order/proceedings in accordance with law would be issued for giving effect to the withdrawal of the preliminary notification. In that view of the matter, this petition deserves to be allowed.

No.196/3 measuring 0-22 guntas owned by the petitioner Nos.1 and 2; Sy. No.197 measuring 0-27 guntas owned by petitioner Nos.3 and 4 and Sy. No.198 measuring 0-31 guntas owned by the petitioner Nos.5 and 6, all situate at Thyagatur Village, Nittur Hobli, Gubbi Taluk, Tumakuru District, are
