This writ petition is filed under Articles 226 and 227 of

the Constitution of India, by the Management, calling in

question, the order dated 30.06.2016 passed by the Presiding Officer, Second Additional Labour Court, Bangalore (for short, ‘the Labour Court’) in I.D.No. 112/2014, whereby the dispute filed by the respondent has been allowed.

2. After service of notice, the respondent is

represented by the counsel. The parties have settled the matter and they have filed a compromise petition under Order XXIII Rule 3 of Code of Civil Procedure. The parties

are present before this Court and have been identified by their respective counsels. The parties have submitted that

The terms of the compromise petition is extracted below:

“The parties above named respectfully submit as follows:

1. The above petition has been filed by the petitioner calling in question the order at AnnexureA dated 30.06.2016 passed by the learned Presiding Officer, II Additional Labour Court, Bengaluru, in I.D. No.112/2014.

2. During the pendency of the above proceedings, with the intervention of elders and well-wishers, the parties have amicably settled their dispute and have agreed to put an end to the litigation on the following terms.

3. The Petitioner has agreed to pay a sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) to the Respondent towards full and final settlement of all claims, demands and reliefs of whatsoever nature arising out of the subject matter of the above proceedings.

4. The Respondent has accepted the aforesaid offer of the Petitioner and undertakes that, upon receipt of the said amount, he shall not press or claim any other relief, amount or benefit from the

Petitioner. The Respondent further acknowledges and agrees that the said sum of Rs.2,50,000/(Rupees Two Lakhs Fifty Thousand only) shall be in full and final settlement of all his claims against the Petitioner.

5. A sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) has been paid to the Respondent herein today by way of Demand Draft bearing No.507204, dated 16/09/2026, drawn on ICICI Bank, Kothanur Branch (1850) Bengaluru, towards full and final settlement of the claims of the Respondent.

6. The parties state that the present compromise has been entered into by them voluntarily and out of their own free will and volition, without any threat, coercion, undue influence, fraud, misrepresentation or other form of pressure whatsoever.”
