THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT, ORDER OR DIRECTION IN THE NATURE OF MANDAMUS OR ANY OTHER WRIT, DIRECTING THE RESPONDENTS TO REMOVE ALL CONSTRUCTION UNDERTAKEN/ERECTED BY THE RESPONDENTS ON THE SCHEDULE PROPERTY WITHOUT THE PETITIONER AND ETC.

ORAL ORDER

The petitioner is before this Court seeking for the

following reliefs;

a. Issue a writ order or direction in the nature of mandamus or any other writ, directing the respondents to remove all construction/erected by the respondents on the Schedule property without the petitioner; and

b. Issue a writ or order or direction in the nature of mandamus or any other writ, directing the respondents not to undertake any construction, including construction of any storm water drain on the schedule property, without the prior permission of the petitioner by following due process of law; and

c. Pass any other order(s) that this Hon’ble Court deems appropriate, in the interest of justice.

MEMO

The Petitioner being aggrieved with the conduct of the Respondents in illegally trespassing into the property of the Petitioner preferred the present writ petition.

The Respondents being aggrieved with order dated 20.04.2023 passed by this Hon’ble Court in the present petition preferred a writ appeal in W.A No. 600/2023.

The parties herein have amicably settled the dispute leading to the filing of the present petition and have filed a joint memo indicating the terms of settlement in W.A No. 600/2023. A copy of the order dated 23.11.2024 passed by this Hon’ble Court in W.A No. 600/2023 is DOCUMENT NO.1.

As per terms of the settlement, the Petitioner herein undertook to withdraw the present petition. Hence, the present memo.

Accepting the said memo and submission of learned counsel for the petitioner, the petition is dismissed as withdrawn.
