The petitioner has challenged the preliminary notification bearing No.CI 41 SPQ 2024 dated 06.03.2024 issued by the respondent No.1 and the final notification bearing No.CI 41 SPQ(E) 2024 dated 31.07.2024 issued by the respondent No.1 (stated as respondent No.3 in the prayer portion of the petition) in respect of a portion of the petition schedule property. It has also challenged the subsequent preliminary notification bearing No.CI 05 SPQ 2025 dated 17.01.2025 issued by the respondent No.1 and the final notification bearing No.CI 02 SPQ (E) 2025 dated 29.03.2025 issued by the respondent No.1 in respect of another portion of the petition schedule property.

When this petition was listed for orders, the learned senior counsel for the petitioner submitted that the impugned notifications are issued for acquisition of land for the purpose of laying a track for a sub-urban rail and hence, the petitioner

does not wish to challenge the same. He, however, submits that the petitioner has laid a model villa in the area notified for acquisition. He submits that if the petitioner is given reasonable time, it would take steps to remove the model villa and make way for the respondent No.4 to implement the project.

Learned counsel for the respondent No.4 after seeking instructions, submitted that four months time may be granted to the petitioner to remove the model villa and clear the acquired property for the implementation of the project.

Though the learned senior counsel for the petitioner persisted that four months would be too short a time for the petitioner to remove the model villa and clear the area, having regard to the fact that the respondent No.4 has already finalized the project and tenders are yet to be issued, interest of justice would be met by directing the respondent No.4 to allow four months time to the petitioner to remove the construction put up by it within the area notified for acquisition and to hand over vacant possession of the property to the respondent Nos.3 and 4 for implementation of the project.
