THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECR THE 1^ST AND 2^ND RESPONDENTS TO PUT THE PETITIONER IN POSSESSION OF HIS SITE BEARING NO.552, FORMED BY THE VISHWABHARATHI HOUSE BUILDING COOPERATIVE SOCIETY LTD., (FORMLY THE WRITERS AND ARTISTS HOUSE BUILDING CO-OPERATIVE SOCIETY LTD.,) AT THE VISHWABHARATHI HOUSING COMPLEX LAYOUT, HOSAKEREHALLI, UTTARAHALLI HOBLI, BANGALORE SOUTH TALUK BANGALORE, MEASURING EAST TO WEST 30 FT., AND NORTH TO SOUTH 50 FT., BY EVICTING THE UNAUTHORIZED OCCUPANT/ENCROACHER FROM THE SAID SITE.

Heard learned counsel appearing for the parties.

The prayer made by the petitioner in this Writ Petition is to direct the respondents to put the petitioner in possession of his site bearing No.552 formed by the Vishwabharathi House Building Co-operative Society, Bengaluru South Taluk.

Taking into consideration that disputed questions of facts are involved in this Writ Petition and also considering that if the petitioner is having any grievance against the respondent - Society, it is open for the petitioner to approach the concerned Authority under the provisions of the Karnataka Co-operative Societies Act, 1959. Reserving such liberty to the petitioner, the Writ Petition is disposed of.
