ORAL ORDER

In this Writ Petition, petitioners are assailing the endorsement bearing No.RRT/UH/CR/E 621427 dated 10.07.2025 (Annexure-A) issued by respondent No.3 and the order dated 05.08.2025 (Annexure-B) passed by respondent No.2 in case No.RP/511/2025.

Having heard the learned counsel appearing for the parties and taking into consideration the order dated 05.12.2024 in W.P.No.32187/2014 (Annexure-H), the operative portion of the said order is extracted below:

ORDER

i) The petition is allowed.

ii) The impugned order dated 7.3.1988 and the impugned notification dated 30.5.1990 are hereby quashed.

iii) The provisions of Urban Land (Ceiling and Regulations) Act, 1976 are not applicable in

respect of the lands bearing Sy.No.1/10, 1/11 and 1/12 totally measuring 1 acre 02 guntas situated at Channasandra Village, Uttarahalli Hobli, Bangalore South Taluk as the Act, 1976 has been repealed by the Act No.5 of 1999.

iv) The respondent No.3 is hereby directed to delete the name of the Government in RTC at Annexures - C, C1 to C8 and restore the name of the petitioner in Sy.No.1/10, 1/11 and 1/12 totally measuring 1 acre 02 guntas situated at Channasandra village, Uttarahalli Hobli, Bangalore South Taluk.

Taking into consideration the fact that this Court has set aside the impugned order dated 07.03.1988 in the aforesaid Writ Petition and further directed respondent No.3 - The Special Tahsildar, Bengaluru South Taluk, Bengaluru, to delete the name of the 'Government' in the RTC extracts and to restore the name of the petitioner therein, in that view of the matter, as the order in W.P.No.32187/2014 was passed on 05.12.2024 as per Annexure-H, I am of the view that, the reasons assigned in the impugned endorsement at Annexure-A dated 10.07.2025

and the order dated 05.08.2025 at Annexure-B are not sustainable in law.

Accordingly, I pass the following:

ORDER

(i) The Writ Petition is allowed.

(ii) The endorsement bearing No.RRT/UH/CR/E 621427 dated 10.07.2025 (Annexure-A) issued by respondent No.3 and the order dated 05.08.2025 (Annexure-B) passed by respondent No.2 in case No.RP/511/2025 are hereby set aside.

(iii) The respondent No.3 is directed to implement the

order passed by this Court in W.P.No.32187/2014 dated 05.11.2024 (Annexure-H), within one month from the date of receipt of certified copy of this order.
