following reliefs:

a) Issue a writ, order or direction in the nature of certiorari, or such other appropriate writ, order or direction, and set aside and quash the common order dated 07.09.2026 passed by the learned X Addl. City

Civil and Sessions Judge, Bengaluru in O.S. No. 6495 of 2026, produced herewith as Annexure 'A', to the extent that it declines the prayers of the Petitioner for ex parte ad interim relief on I.A. No. 1 and on I.A. No. 4.

b) Consequently, allow the prayer of the Petitioner for ex parte ad interim relief in terms of I.A. No. 1 and grant an order of temporary injunction restraining Respondents No. 1 to 7, whether by themselves or through Respondents No. 3 or 4 or through their partners, servants, agents or any person acting on their behalf, from undertaking any activity in a line of business similar to that of the Petitioner, inter alia the manufacture of shoulder pads, ready sleeve heads, ready chest pieces and waistbands and the sourcing of armhole tapes, pending disposal of the suit or for such period as this Hon'ble Court or the Trial Court may deem fit.

c) Consequently, allow the prayer of the Petitioner for ex parte ad interim relief in terms of I.A. No. 4 by appointing a Court Commissioner under Order XXVI Rule 9 read with Order XXXIX Rule 7 of the Code of Civil Procedure, 1908 to visit the premises of Respondents No. 3 and 4 at 1st Floor, No. 152/B, Jigani Link Road, Jigani, Bommasandra Industrial Area, Bengaluru, and to inspect, list, photograph and preserve the books of account, records, electronic data, machinery and stock found therein.

d) In the alternative to prayers (b) and (c) above, remit I.A. No. 1 and I.A. No. 4 to the Trial Court with a direction to reconsider and dispose of the prayers for ex parte ad interim relief afresh, in accordance with law and by a reasoned order, within such time as may be fixed by this Hon'ble Court.

e) Pass such other and further order or orders as this Hon'ble Court may deem fit in the facts and circumstances of the case and in the interest of justice and equity.

After arguing for some time, learned counsel for the petitioner submits that the petitioner may be permitted to withdraw the above petition with liberty to address all contentions before the trial court when the matter is taken up on 22.09.2026 and post thereof.

Reserving such liberty, the petition stands disposed . Since there are some issues involved and are relating to growing business, the trial court is requested to expedite the hearing of the applications.
