ORAL ORDER

Sri.Sushant, counsel on behalf of Sri.Chintan Chinnappa M., and Sri.K.V.Lokesh, counsel for caveator / respondent No.1 appeared in person.

This petition is filed seeking following reliefs:

(i) Issue writ of Certiorari quashing the e- auction sale notice 27.05.2025 (Annexure-A) and auction confirmation dated 17.06.2025 (Annexure-B) issued by the respondent No.1.

(ii) Consequently, restore status quo ante and cancel the confirmation of sale by the respondent No.1 Bank in favour of the respondent No.2 in terms of the letter dated 17.06.2025 issued by the respondent No.1 Bank to the petitioners.

(iii) Pass any such further order as this Hon'ble Court may deem fit in the facts and circumstances of the present case.

Sri.K.V.Lokesh, counsel submits that a memo has been filed stating that the petitioner herein had sought the same relief as sought in the writ petition before DRT in S.A No.272 of 25 and the Tribunal vide order dated 30.09.2025 has dismissed the appeal. Hence, the petition may be dismissed.

Submission is noted. Memo is placed on record.

Perused the same with care. As could be seen from the order of the DRT, the petitioner had questioned the e-auction sale notice dated 27.05.2025 before the DRT in S.A.No.272 of 2025 and the same has been disposed by the Tribunal on 30.09.2025. Hence, the prayer sought in the writ petition cannot be considered. Accordingly, the writ petition is

dismissed .
