This petition has been filed seeking for issuance of a

direction to consider the representation of the petitioner at Annexure-'H' dated 03.08.2026. In terms of Annexure-'H', the petitioner states that he has joined the BBA Course at Government College and hence, he seeks to join the said College and has sought for return of original documents.

Upon issuance of notice, the respondent no.3 -

City Engineering College has appeared through learned counsel and in the Court they have returned the following documents to the petitioner:-

Insofar as the Transfer Certificate is concerned,

the respondent No.3 undertakes to return the same, if an application is made in the prescribed format. Further, it is stated that NOC from the Departments, such as, Library etc. is required to be taken in order to ensure that there are no dues of the student vis-à-vis of the other Departments and the said format is enclosed

Learned counsel for the petitioner submits that in light of the undertaking given by respondent No.3 insofar as Transfer Certificate is concerned, an application would be made in accordance with the requisite format and NOC as per the format at Annexures-'R2' and 'R3' would also be applied for.

It is further submitted that, since the student

did not join the Course, there are no dues to the Departments, but however, he would also apply for the NOC.

Learned counsel appearing for the respondent No.3 would submit that they have faced financial loss in light of the petitioner having left the seat without sufficient prior intimation.

Insofar as such claim of respondent No.3-

College is concerned, all contentions are kept open for the third respondent to assert any claim that they have against the petitioner as is permissible in law.

Accordingly, the petition is disposed of.
