In this writ petition, the petitioner is challenging the Notification dated 14^th June, 2024 (Annexure-A) issued by the respondent No.1-Assistant Registrar of Co-operative Societies and Recovery Officer for auction of immovable property in question.

Having taken note of the submission made by

learned counsel appearing for the parties and on perusal of the averments made in the writ petition, the same would indicate that the petitioner had not challenged the original order of Award made by the competent authority. Therefore, I am of the view that, unless the award is challenged, subsequent events cannot be challenged.

In that view of the matter, taking into consideration

the submission made by learned counsel appearing for the petitioner, writ petition is dismissed, reserving liberty to the petitioner to approach the competent authority by challenging the award, if so advised.
