This case was disposed of vide order dated

18.03.2026 which reads thus:

“Learned counsel for the petitioner submits that the

petition has become infructuous.

Submission is placed on record.

Writ petition is dismissed as not-pressed.”

Application, I.A. No. 1/2026 is filed to recall the

said order on the premise that petition does not become infructuous and though the petitioner has retired from service, unless the order is set aside petitioner will have to face the consequences post retirement as retirement benefits would be denied to some extent.

Learned counsel for respondent, would submit that the petitioner retired in the month of February, 2019. Penalty

was imposed in the month of January, 2019. In terms of the penalty imposed petitioner would lose one increment permanently.

Learned counsel for respondent, on instructions,

with a direction to the respondent – Corporation to recalculate the terminal benefits payable to the petitioner, taking into consideration deduction of one increment which is imposed in terms of the order passed by the Disciplinary Authority.
