The petitioner is before this Court seeking following

reliefs.

"a. Issue a writ in the nature of Certiorari quashing the Cancellation Letter bearing No. KIADB/ HO/ ALLOT/Secy-2/ 23544/15101/ 202223 dated 29/11/2022 issued by the KIADB as illegal and non-est(Annexure-A).

b. Issue a writ in the nature of Mandamus directing the KIADB to accept the balance sum of Rs.55 Crores and issue Allotment letter by furnishing the details of plot and Sketch. (Annexure-B)

c. Issue a writ in the nature of Mandamus directing the Respondents to consider petitioner representation dated 14.12.2022 bearing No.VSFPL/PKM/003/2022-23 in accordance to law. (Annexure-B)

d. Issue a writ in the nature of Mandamus declaring that the cancellation letter dated 29/11/2022 issued by the Annak-A Respondent KIADB is highly arbitrary, illegal and bad in law.

e. Issue any other order as deems fit to the facts and circumstances of the case and to meet the interest of justice."

It is the case of the petitioner that, upon approval of the project proposal by the State Level Single Window Clearance Committee (SLSWCC) for establishment of a “Warehouse, Logistics and Industrial Infrastructure” project, a recommendation was made for the allotment of an extent of 100 acres of land at Jakkasandra Industrial Area II Phase (Mindahalli Village), Malur Taluk, Kolar District. The same was communicated vide letter dated 29.11.2022 as per Annexure-A. Thereafter, by communication dated 14.01.2022, produced at Annexure-J, the petitioner addressed KIADB requesting issuance of a revised demand note along with details of the plot number and survey numbers allotted to them.

In furtherance thereof, by communication dated 04.03.2022, KIADB issued a demand note calling upon the petitioner to pay the tentative cost for 100 acres of land at the

tentative allotment rate of Rs.220 lakhs per acre. The initial deposit of 30% required to be paid in terms of the demand note amounted to Rs. 66,00,00,000/-. Out of the said amount, a sum of Rs. 10,94,00,000/- had already been deposited and the balance payable towards the initial 30% deposit was Rs. 55,11,00,000/-.

Thereafter, by communication dated 29.11.2022, produced at Annexure-A, the respondent–KIADB sought to cancel the process of allotment of 100 acres of land in favour of the petitioner.

The petitioner is before this Court seeking a direction to the respondent–KIADB to consider his representation dated 14.12.2022, wherein the petitioner requested furnishing of the plot number and survey details so as to enable him to remit the balance amount.

Learned counsel for the petitioner, taking this Court

through the records, submits that since the respondent–KIADB has not furnished the details of the 100 acres of land proposed to be allotted, the demand raised vide communication dated 04.03.2022 could not be complied with. It is contended that the

bare minimum the petitioner is expected to know is the particulars of the land for which he is required to make the payment.

Pursuant to the directions of this Court, the respondent–KIADB has furnished a memo dated 18.02.2026 along with a sketch, providing the details of the land identified for allotment to the petitioner, being Plot No. 1 (61.80 acres) and Plot No. 2 (36.65 acres) in Jakkasandra Industrial Area II Phase (Mindahalli Village), Malur Taluk, Kolar District.

The learned counsel for the petitioner has also filed a memo along with a copy of the solvency certificate issued by Federal Bank, indicating the petitioner’s readiness and willingness to make the payment as demanded by the respondent.

In that view of the matter, following:

(i). The writ petition is allowed .

(ii). Annexure-A, insofar as it cancels the allotment process, is hereby quashed.

(iii). The respondent–KIADB is directed to consider the representation of the petitioner and pass appropriate orders in accordance with law within an outer limit of 30 days from the date of receipt of a certified copy of this order.

(iv). The process of allotment, raising of the demand and the payment thereof shall be strictly in accordance with the regulations provided for.
