The present writ petition is filed seeking the following

“Wherefore, the petitioner in the above case pray that this Hon’ble Court be pleased to;

a. Issue a writ of certiorari or any other writ of like nature and quash the Notice dated 27.05.2026, bearing No. ಪ.ಸo.ಸ�ಇo(�)/ಸಇo(�)/�4/2026-27-496 issued by the 3^rd respondent vide Annexure C to the writ petition and also direct the 3^rd respondent to restore the electricity connection to MS4EEH239559 to the petitioner’s property and,

The facts of the case are that the petitioner is the absolute owner of the property bearing No.110 in “HAMLET LAYOUT”, measuring East to West 40 feet, North to South 50 feet, totally measuring about 2000 Square Feet, carved out of Sy.No.143 and Sy.No.144. Both situated at Channasandra village, Bidarahalli Hobli, Bangalore East Taluk, Bangalore. It is the case that the petitioner has purchased the property by way of a registered sale deed dated 10.10.2022. He has been given permanent electricity connection on 08.07.2024.

Learned counsel appearing on behalf of the petitioner submits that as per the notification issued by the Government of Karnataka, dated 22.06.2026, the property which is less than 2400 square feet is exempted from furnishing the occupancy certificate. It is submitted that the petitioner has constructed the building long back and also obtained necessary electricity and water connection to the building. It is submitted that the respondents have issued a notice on 27.05.2025 threatening to disconnect the electricity supply on the ground that the GBA had directed to disconnect power supply immediately on the ground that it is an illegal

construction and on 02.07.2026 they have disconnected the power supply. It is submitted that in the light of the said notification issued by the Government dated 22.06.2026, the action of the respondent is arbitrary and based on the said communication issued by the GBA, they cannot disconnect the power supply.

Learned counsel appearing for respondents Nos. 2 and 3 has placed before the Court the notification issued by the Government dated 22.06.2026, stating that for the property below 2,400 Sq ft. the production of occupancy certificate is not necessary. The person claiming benefit under the G.O. has to submit an application within 15 days from 22.06.2026. It is submitted that the petitioner is seeking exemption under the said, within 15 days from the date of receipt of order, he has to make an application. It is submitted that if the application is filed, it will be considered in accordance with law.

Having heard the learned counsels on either side, perused the material on record. The petitioner is entitled to the benefit under the Government notification, hence, the respondents are directed to forthwith restore the power supply,
