The petitioner is before this Court seeking for the following reliefs:

a) Issue a writ, order or direction in the nature of certiorari to quash the cancellation order dated 18.06.2021 (Annexure-C) in respect of the Site as the same is illegal, arbitrary and in violation of principles of Article 14 of the Constitution of India.

b) Issue a writ of mandamus directing the respondent not to evict the petitioner from the scheduled property.

c) Pass such other order/s which this Hon’ble Court deems just and proper in the circumstances of the case in the interest of justice and equity.

The short grievance of the petitioner is that before the cancellation order dated 18.06.2021 at Annexure-C was passed, no notice had been issued.

The counsel for respondents No.1 and 2, on instructions, submits that since the plot was empty

Before passing any order of cancellation of allotment, it is but required that notice is issued. In the present case, admittedly notice not being issued, I pass the following:

i. The Writ petition is allowed. A certiorari is issued. The order dated 18.06.2021 at Annexure C is quashed.

ii. Liberty is reserved to the respondents to issue a fresh notice to the petitioner at the address indicated in the cause title. and thereafter proceed in accordance with law.
