This petition is filed by accused Nos.1 and 2 under Section 528 of BNSS / 482 of Cr.P.C praying to quash the proceedings in C.C.No.5122/2026 arising out of crime No.142/2026 of Kadugodi Police Station pending on the

file of Additional Chief Judicial Magistrate, Bengaluru Rural

District, Bengaluru registered for offences punishable under Sections 118(1), 351(2), 352 read with Section 3(5) of BNS.

2. On the complaint of respondent No.2, a case has been registered against petitioners in Crime No.142/2026 of Kadugodi Police Station for offences punishable under Sections 118(1), 351(2), 352 read with Section 3(5) of BNS. The police after investigation have filed charge sheet against petitioners for aforesaid offences. On the basis of said charge sheet, the case has been registered against petitioners in C.C.No.5122/2026 pending on the file of Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru. Petitioners have sought quashing of charge sheet and proceedings of the said criminal case in the present petition.

3. Petitioner Nos.1 and 2, respondent No.2 and one Dhananjay are present. Application under Section 359 of BNS jointly signed by petitioner Nos.1 and 2, respondent No.2 and said Dhananjay is filed. Respondent

No.2 and the said Dhanajay who are victim -injured submits that they have settled the matter with petitioners and they have no objections to quash the proceedings against petitioners.

4. In view of the said settlement, the proceedings against petitioners in C.C.No.5122/2026 pending on the file of Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru are quashed.

Accordingly, the petition is disposed of.
