This petition is filed seeking the following reliefs: (a) Issue a writ of mandamus, or any other appropriate writ, order or direction, declaring the action of respondent no.1/NBEMS in treating the petitioner's application for the FMGE June 2026 session as ‘deficient’ solely for non-submission of a particular formatted NEET-UG scorecard, despite the petitioner having furnished the official e-mail communication dated 08.09.2022 issued by respondent No.2/NTA evidencing her NEET(UG)-

2022 result, as arbitrary, illegal and unconstitutional.

(b) Issue a writ of mandamus, or any other appropriate writ, order or direction, directing respondent nos.1 and no.2 to accept the e-mail dated 08.09.2022 vide Annexure-B as due and sufficient compliance with the requirement of submission of the NEET-UG scorecard/eligibility certificate for the FMGE June 2026 session, as also for all future FMGE examinations, and to remove the deficiency reflected against the petitioner's application on the FMGE portal.

(c) Issue a writ of mandamus, or any other appropriate writ, order or direction, directing respondent no.1/NBEMS to permit the petitioner to appear in the FMGE June 2026 examination scheduled to be held on 28.06.2026, and to issue an admit card to the petitioner without any further delay.

(d) Pass such other writ(s), order(s) or direction(s) as this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice and equity.

Learned Counsel for the respondents states that the petitioner had applied to the respondents to accept the NEET-UG scorecard Eligibility Certificate given in the year 2022 for the Foreign Medical Graduate Examination (FMGE) of June 2026 for getting admission in a University in Malaysia.

It is stated that the period of validity of such a

certificate granted to a candidate by NEET is for a period of three years which had already expired. Despite that the

petitioner had approached this Court a day prior to the FMGE examination scheduled to be held in June 2026. This Court was pleased to pass an order permitting the petitioner to appear in the said examination. However, it is stated that though the petitioner appeared, the result is withheld in view of the pendency of this petition. It is contended that since the eligibility for FMGE examination is a valid NEET scorecard, the validity of the petitioner’s NEET scorecard having already expired in the year 2025 and even otherwise, she had not attained the requisite marks in the NEET examination of 2022 that were required for FMGE examination, therefore, she is not qualified for that.

Under the circumstances, we find no merit in this petition and it is accordingly dismissed. Interim order, if any stands discharged.
