This petition is filed by the All India Central Council of Trade Unions, represented by its President, seeking the following reliefs:

a) Issue a writ of mandamus or any other appropriate writ, order or direction, directing the respondents to revise the minimum wages in accordance with the parameters laid down by the Hon’ble Supreme Court in Secretary v. Management of Reptakos Brett and Co. Ltd. & Anr. , Civil Appeal No. 4336 (NL) of 1991, decided on 31.10.1991, reported in AIR 1992 SC 504, with effect from 20.01.2022, produced as Annexure-H.

b) Pass such other order or direction as this Hon’ble Court may deem fit in the facts and circumstances of the case, including an order as to costs, in the interests of justice and equity.

The petitioner is the All India Central Council of Trade Unions (hereinafter referred to as “AICCTU”), which is recognized by the Government of India and works among thousands of workers employed in both the organized and unorganized sectors across India, including the State of Karnataka. The object of the petitioner-Union is to organize workers and strive for the improvement of their standard of living by advocating better wages, dignified working conditions, and the establishment of a just and egalitarian social order in the country. The principal grievance of the petitioner is that, under the Minimum Wages Act, 1948, minimum wages are required to be fixed and revised at intervals not exceeding five years. The minimum wages were last revised in the year 2017, and no further revision has been effected thereafter. Hence, the present petition has been filed seeking a writ of mandamus directing the respondents to undertake and complete the process of revision of minimum wages in accordance with law.

Learned counsel appearing for the respondents submitted that the members of the petitioner-Union are employees working in different establishments and that their claim for revision of minimum wages would be considered in accordance with law, having regard to the provisions of the Minimum Wages Act, 1948, as well as the Code on Wages, 2019. He further submitted that the entire process of revision of minimum wages would be completed and an appropriate notification would be issued within five months from the date of receipt of a copy of this order.
