Petitioner is before this Court seeking for the following

reliefs:

a. Issue writ in the nature of Mandamus directing the Respondent No.3 to register the complaint on the basis of the complaint lodged by the petitioner dated 27.11.2025 under Annexure C2.

b. Issue such other order/direction as may be deemed to fit in the facts and circumstances of the case in the interest of justice and equity.

The grievance of the petitioner is that the petitioner being the absolute owner of the property bearing No.10/1, PID No.36-8-10/1, Karithimmanahalli, Kasturiba Nagar, Bengaluru in Ward No.36, Govindrajanagara SubDivision, had purchased the same under a registered sale deed dated 29.01.1985, o ne Mr. Rajanikanth G. S. had mortgaged the property impersonating the petitioner and in pursuance of the said mortgage, the Bank was proposed to take action in relation thereto.

The petitioner has filed a suit in O.S.No.2374/2019, which was dismissed, as regards which R.F.A.No.2374/19 is pending.

The petitioner had also submitted a complaint on 27.11.2025 as regards the impersonation, which has been refused to be acted upon on the ground, i.e., civil proceedings which are pending. The criminal complaint which has been filed is as regards the impersonation, which is a criminal offence. That being so, it would be required for the criminal offence also to be investigated despite the pendency of the civil proceedings.

In that view of the matter, I pass the following:

i) Writ petition is allowed .
