THIS WRIT PETITION IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT OF MANDAMUS DIRECTING THE RESPONDENTS TO RELEASE PETITIONER / CONVICTED PRISONER BEARING CTP NO. 15288 ON GENERAL PAROLE FOR A PERIOD OF 90 DAYS BY CONSIDERING THE POLICE REPORT DTD. 16.10.2025 (ANNX-F) AND CITING THAT ILLNESS OF THE CONVICT FATHER IN THE INTEREST OF JUSTICE AND ETC.

The petitioner is before this Court seeking for the following reliefs:

a. Issue a writ of Mandamus directing the respondents to release Petitioner/convicted prisoner bearing CTP No.15288 on general parole for a period of 90 days by considering the police report dated 16.10.2025 (Annexure-F) and citing that illness of the convict father in the interest of justice.

b. Grant such other order or directions for the benefits petitioner as this Hon’ble Court deems fit in the interest of justice and equity.

The detenu was convicted for offences under Section 120B, 143, 147, 148, 114, 302 and 149 of IPC by Judgment and Order of Sentence dated 09.04.2025 passed by the II Additional District and Sessions Judge, Ramnagara, sitting at Kanakapura in SC No.

5001 of 2024. The highest of the sentence being for life imprisonment, the petitioner has been has been under custody from 06.09.2021 and as on 18.11.2025 has been incarcerated for a period of 4 years 1 month 27 days.

The detenu had made an application for grant of general parole, on the ground that his father is unwell and requires medical attention. His father is suffering from locomotive disability of 75%. The disability certificate had also been produced. The respondent not having considered the same, petitioner is before this court.

A perusal of the papers indicates that the detenu has been in custody for a period of 4 years, 1 month, 27 days as on 18.11.2025. The medical certificate and the disability certificate indicate 75% disability of the father of the detenu, who requires medical treatment. The detenu having been released emergency parole on one earlier occasion for a

period of 14 days, he has completed the said period of parole and surrendered to the jail authorities without any complaint.

Considering the above facts, I am of the considered opinion that the petitioner can be released on parole for a period of 60 days to take care of his father, who is suffering from 75% locomotive disability. Since there is no particular complaint against the conduct of the detainee during his term of incarceration, as

also during time that he was granted emergency parole, I pass the following:

ORDER

i) The Writ Petition is allowed .

ii) Respondent–Chief Superintendent, Central Prison, Bangalore, is directed to release the detenu- Karthik.S [CTP No.15288] on parole for a period of 60 days commencing from 22.06.2026, subject to the following conditions: a) The prisoner- Karthik.S [CTP No.15288] shall mark his attendance in the jurisdictional Police Station, weekly once

throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of parole.

b) Respondent No.1- State of Karnataka shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole.

iii) The Registry is directed to communicate the order to the prison authority for its immediate execution.
