Learned counsel for the petitioners and respondent No.2 jointly submitted that the matrimonial dispute stood settled amicably and applied under Section 320 r/w. 482 of the Cr.P.C. with affidavits, agreeing to pay a total of Rs.25,00,000/- to respondent No.2 through demand drafts (including Rs.15 lakhs handed over in Court and Rs.5 lakhs already paid), withdrawal of DVA.No.8/2024 and CMC.No.618/2025, withdrawal of Crl.A.No.59/2025, dissolution of the marriage by mutual consent under Section 13(B) of the Hindu Marriage Act, 1955, and mutual non-claims including alimony. The petitioners are before this Court calling in question proceedings in C.C.No.666/2025, pending before the Principal Civil Judge and JMFC, Bangarpet, Kolar, for the offences punishable under Sections 498A, 323, 504, 506 and 34 of the of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court seeking permission to compound the afore-quoted offences.

The parties have filed an application under Section 320 r/w. 482 of the Cr.P.C., and separate affidavits of the parties, before this Court.

The petitioners hand over a demand draft of Rs.15/lakhs, apart from Rs.5/- lakhs which is already paid and the receipt of which is acknowledged by the complainant, who is present before this Court and her learned counsel.

The application reads as follows:

“2. It is submitted that since the entire criminal proceedings arose out of the matrimonial discord between the 2^nd respondent and the accused No.1/husband, due to the intervention of the elders in the family, the issues have been resolved and the parties to the lis have agreed to settle the dispute between them by entering into a compromise with the following terms and conditions, which are as under:

1) The petitioners along with the accused No.1/husband of the 2nd respondent have agreed to pay a total sum of Rs.25,00,000/- in favour of the 2nd respondent towards the full and final settlement of all the claims arising out of their matrimonial relationship.

ii) The 2nd respondent has agreed to receive the aforesaid amount of Rs.25,00,000/- by way of Demand Draft/s as a full and final settlement of all the claims

arising out of the matrimonial relationship with the petitioners and the 1st accused/husband.

iii) As part of the settlement, a sum of Rs.15,00,000/- is agreed to be paid to the respondent No.2 at the time of disposal of the present petition by way of a settlement and accordingly, the Demand Draft bearing No.600220 dated 29.01.2026 for a sum of Rs.10,00,000/- and Demand Draft bearing No.600238 dated 20.02.2026 for a sum of Rs.5,00,000/-, both drawn on State Bank of India, Kolar, thus, totalling to the tune of Rs.15,00,000/- is paid to the 2nd respondent at the time of disposal of the present writ petition i.e., WP.No.11960/2025 and the writ petition in WP.No.35889/2024 preferred by the 1st accused/husband challenging the lookout circular (LOC), which was issued in connection with the case in Cr.No.275/2024 (CC No. 666/2025) by the 1st respondent/ Bangarpet PS, as settled between the parties.

iv) As part of the settlement, a sum of Rs.5,00,000/- shall be paid by the petitioners and the 1st accused/husband in favour of the 2nd respondent under the Demand Draft bearing No.600244 dated 23.02.2026 for a sum of Rs.5,00,000/- drawn on State Bank of India, Kolar, at the time of withdrawal of the Domestic Violence Petition in DVA.No.8/2024 and the Execution Petition in CMC

No.618/2025 filed by the 2nd respondent, which is pending before the Principal Civil Judge and JMFC Court, Bangarpet.

v) agreed As part of the settlement, the 2nd respondent has to dissolve the 1st marriage with the accused/husband/Chethan Gopala Reddy, which was solemnized on 27.11.2020 at SN Resorts, Bangarpet Taluk, Kolar District, which got registered before the Registrar of Marriage, Bangarpet Sub-Registrar, Bangarpet as the document bearing No.BTP-HM-5002021-22 dated 09.12.2021 by filing a divorce petition on mutual consent under Section 13(B) of the Hindu Marriage Act, 1955 before the jurisdictional Family Court. At the time of recording of the evidence in the aforesaid matrimonial case seeking divorce by mutual consent, the 2nd respondent shall be paid the balance sum of Rs.5,00,000/under the Demand Draft bearing No.600245 dated 23.02.2026 for a sum of Rs.5,00,000/drawn on State Bank of India, Kolar by the petitioners and the 1st accused/husband. vi) Subject to the withdrawal of the domestic violence petition in DVA No.8/2024 and the execution petition in CMC.No.618/2025, pending before the Principal Civil Judge and JMFC Court, Bangarpet, the 1st accused/husband has agreed to withdraw the Crl.A.No.59/2025 pending before the III Additional District and Sessions Judge, Sitting at KGF.

vii) The petitioners along with 1^st accused/husband and the 2nd respondent have agreed to retain the gold, silver and diamond articles which are in possession of the respective parties and that there shall not be any claims made regarding the said articles in the future.

viii) The petitioners along with 1st accused/husband and the 2nd respondent have agreed to not make any further claims against each other inclusive of the alimony in the present or the future. Furthermore, there shall not be any further civil or criminal proceedings arising out of the matrimonial relationship between the petitioners along with 1^st accused/husband and the 2nd respondent.

ix) The parties to this settlement undertake to abide by the terms and conditions stated in the preceding paragraphs and any breach of the terms and conditions by either of the parties, the aggrieved party will be at liberty to seek appropriate remedies available under law for the quashing of the case in Cr.No.275/2024 (CC.No.666/2025) registered by the 1st respondent/Police and also the closure of the domestic violence petition in DVA.No.8/2024 along with the execution petition in CMC.No.618/2025, all pending before the Principal Civil Judge and JMFC Court, Bangarpet. Further, any orders passed by the Courts of law on the score of the present settlement shall be binding on all the parties to the lis.

X) Both parties submit that they shall not interfere with each other's life, liberty, privacy or that of their respective family members either directly or indirectly in future. Both parties shall live independently as per their free will and consent. In the event of any future grievance, either party shall be at liberty to seek appropriate remedy in accordance with law. ”

In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the application, the affidavits of the parties and terminate the proceedings against the petitioners, as the allegations are not against the State.
