The petitioner has filed the present petition as a Public Interest Litigation inter alia praying that directions be issued for cancellation of consent for operation [ CFO ] granted by respondent No. 2-Karnataka State Pollution Control Board [ KSPCB ] to respondent No.5.

The petitioner alleges that respondent No.5 is running a poultry farm [the Farm ] in violation of the environmental guidelines issued by the Central Pollution Board. The petitioner submits that the Farm is maintained in a poor hygienic condition and foul smell is emanating from the said Farm. Petitioner also submits that there is insect infestation on account of the unhygienic conditions and the Farm has now become a health hazard to the residents and to the patients admitted to the DSI Medical College.

The learned counsel appearing for the KSPCB submits that the present petition is not a Public Interest Litigation, but is motivated by the petitioner who wants to expand its operations,

but perhaps cannot do so because the Farm is located in the adjacent land. He further submits that since the petitioner has raised an issue regarding violation of environmental guidelines and has also alleged that the Farm is polluting the environment, the KSPCB shall take the necessary steps to conduct an investigation and if it is found that the Farm is being run contrary to the Norms and Standards specified, the KSPCB shall take the necessary steps in accordance with law.

In view of the aforesaid statement, no further orders are required to be passed in the present petition. Hence, the petition is disposed of.
